Membership Code of Conduct

Membership, Code of Conduct and Payment Policy

Build Health Studios Pty Ltd | Effective date: 1 June 2026

1.1 Booking Policy

  All class bookings must be made online via the Build Health Studios booking platform. Bookings are not accepted via phone, email, or social media.

  Bookings open 14 days in advance for all members.

  Walk-ins are permitted on a space-available basis only and cannot be guaranteed.

  A towel is mandatory for attendance at all classes.

  Members are requested to arrive at least 5 minutes before class begins to check in, store belongings, and be briefed on the session.

  A strict 5-minute cut-off applies. Members arriving more than 5 minutes after class start time will not be admitted.

1.2 Cancellation Policy

  Classes have an early cancellation window of at least 2 hours before class start.

  Cancellations made within 2 hours of class start time are counted as a late cancellation.

  Non-attendance without prior cancellation is recorded as a no-show.

  All cancellations must be made online using Gymdesk. Cancellations made by phone, email, or social media will not be accepted.

1.3 Late Cancel & No-Show Consequences

  Casual visits, Introductory Offers, and Class Pack holders: one session may be forfeited for a late cancellation or no-show.

  Unlimited Membership holders: any late cancellation fee or no-show fee must be clearly disclosed at the time of purchase or booking and will only be charged in accordance with the member's selected membership terms.

  Private sessions require 12 hours prior notice to cancel. If less notice is given, the applicable session fee or session credit may be forfeited, subject to any mandatory rights under law.

1.4 Waitlist Policy

  Members are encouraged to add themselves to class waitlists as spots regularly become available.

  If a space becomes available before the relevant cancellation window closes, a member may be automatically moved from the waitlist into the class and will be treated as booked once notified through the booking platform.

  Members will not ordinarily be moved from the waitlist into a class within 2 hours of class start, but Build Health Studios may manually offer an available place to a waitlisted member who elects to accept it.

  Being placed on a waitlist indicates willingness to attend if moved in. If circumstances change, members must remove themselves from the waitlist before the cancellation window closes to avoid applicable late cancellation fees.

  Members booking early morning classes are responsible for checking their booking status before class if they have joined the waitlist.

1.5 Instructor Changes

  Build Health Studios may substitute or change instructors from time to time where reasonably necessary.

  The advertised class style, format, and timetable may change from time to time, including due to instructor availability, safety, demand, or operational requirements.

  If a material change or cancellation occurs, Build Health Studios will use reasonable efforts to notify affected members promptly through the booking platform, SMS, or email.

2. Studio Conduct & Code of Behaviour

2.1 General Code of Conduct

Build Health Studios is committed to providing a welcoming, safe, and respectful environment. All members, guests, and staff are required to:

  Treat all members, coaches, and staff with courtesy and respect.

  Refrain from discriminatory, harassing, or intimidating behaviour of any kind.

  Avoid unsolicited coaching, commentary, or personal remarks towards other members during classes.

  Maintain appropriate personal hygiene and wear clean training attire.

  Bring and use a sweat towel to wipe down equipment after use.

  Return all equipment to its designated storage location after use.

  Avoid using mobile phones during class. Phones should be on silent or in personal storage.

  Report any damaged equipment, hazards, or maintenance issues to a coach or studio staff immediately.

2.2 Prohibited Conduct

The following conduct is strictly prohibited on Build Health Studios premises:

  Use of offensive, discriminatory, or abusive language.

  Physical aggression, threatening behaviour, or intimidation toward any person.

  Unsolicited recording (audio or video) of other members or staff without consent.

  Bringing alcohol or illicit substances onto the premises.

  Attending class under the influence of alcohol or drugs.

  Sharing access credentials or allowing others to use a member's account.

2.3 Consequences of Misconduct

Build Health Studios reserves the right to respond to misconduct proportionately and reasonably, including by:

  Issue a formal warning for a first or minor breach of the General Code of Conduct (clause 2.1).

  Suspend membership access for repeated, serious, or continuing breaches of the General Code of Conduct (clause 2.1).

  Terminate a membership immediately for serious misconduct, repeated breaches of the General Code of Conduct, or any serious breach of the Prohibited Conduct provisions (clause 2.2), acting reasonably in the circumstances.

Appeals regarding conduct decisions should be directed in writing to hello@buildhealthstudios.com.au within 7 days. Build Health Studios will review any appeal in good faith and communicate the outcome in writing within a reasonable time.

Nothing in this policy limits any rights Build Health Studios may otherwise have at law in relation to misconduct, damage to property, unpaid fees, or unlawful conduct.

3. Health, Safety & Risk

3.1 Health & Safety Requirements

For the safety of all participants, members and guests must take reasonable care when using the studio, equipment, and amenities.

·         Members should only participate in classes or activities they are medically and physically fit to undertake.

·         Members must inform Build Health Studios before participating if they have any injury, illness, pregnancy, medical condition, or restriction that may affect safe participation.

·         Members must follow all reasonable directions given by instructors and staff in relation to safe participation and use of equipment.

·         Build Health Studios may refuse or stop participation where it reasonably considers that attendance may present a health or safety risk to the member or others.

3.2 Participation, Risk & Liability

Physical exercise and use of gym equipment involve inherent risks, including the risk of injury. By attending the studio, members acknowledge those inherent risks and agree to participate at their own risk to the extent permitted by law. Nothing in this policy excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law. Build Health Studios does not exclude liability for reckless conduct or for liability that cannot be excluded by law.

3.3 Personal Property & Damage

Members are responsible for their personal belongings. To the extent permitted by law, Build Health Studios is not responsible for loss, theft, or damage to personal property brought onto the premises. Members may be held responsible for damage to studio property or equipment caused by wilful misconduct, misuse, or negligent acts.
