This Privacy Policy explains how Build Health Studios Pty Ltd (we, us or our) collects, holds, uses and discloses personal information, including health information and CCTV footage, in connection with our gym, personal training, classes, website, apps, social media pages and related services. We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and, where applicable, health records laws.


1. Information we collect

We may collect personal information that is reasonably necessary for our functions and activities, including your name, contact details, date of birth, emergency contact details, membership and attendance information, payment and billing details, communications with us, and information about your use of our website, apps and facilities. We may also collect sensitive information, including health or medical information, where reasonably necessary to assess whether our services are suitable for you, to provide training safely, or where otherwise permitted by law including:

      Directly from you when you sign up, complete pre-exercise questionnaires, book classes, make purchases, contact us, enter promotions, or otherwise interact with us online or in person.

  From your ongoing participation, including attendance records, training preferences, progress notes, incident reports, and updated health screening information.

  From third parties such as payment processors, booking platforms, referral partners, or another person acting on your behalf, where lawful and appropriate.

  Automatically through our website, apps, Wi‑Fi, CCTV, cookies and similar technologies, where used.

Where CCTV operates at our premises, this may include visual recordings of members, guests and visitors while entering, exiting or using the premises.

2. How we use personal information

We use personal information for the primary purposes for which it was collected and for related purposes you would reasonably expect, including to:

      Set up and administer memberships, class bookings, waitlists, payments, debt recovery and customer support.

  Assess your suitability for training, tailor programs, and help protect your health and safety while using our services.

  Communicate with you about bookings, changes to our timetable, membership matters, incidents, service updates and administrative notices.

  Send you marketing communications about our services, events and promotions where permitted by law, and provide a simple means to opt out.

  Improve our facilities, services, programs, website and user experience, including by analysing usage trends and feedback.

  Investigate complaints, incidents, misconduct, fraud, security events or suspected unlawful activity.

  Comply with our legal and regulatory obligations.

3. Disclosure of personal information

      We may disclose personal information to our staff, trainers, contractors and service providers who assist us with membership management, payments, IT systems, website hosting, customer communications, professional advice and business operations.

  We may disclose health information where reasonably necessary to protect your health or safety, in an emergency, with your consent, or as otherwise authorised or required by law.

  We may also disclose information to insurers, legal advisers, regulators, law enforcement agencies, courts or other authorities where required or permitted by law.

  We do not sell personal information to third parties.

4. Direct marketing

Where permitted, we may use your personal information to send you news, offers and promotions about our business. You can opt out of marketing communications at any time by using the unsubscribe function in the communication or by contacting us using the details below. We will continue to send service or transaction-related communications where necessary.

5. Website, cookies and CCTV

CCTV cameras are installed and operate at our premises. By attending, entering or using our premises, members and visitors acknowledge and consent to the collection of their image and related personal information by CCTV recording. We use CCTV for safety, security, incident investigation, risk management and loss prevention. CCTV footage may be viewed by authorised personnel and disclosed where reasonably necessary for these purposes or as otherwise required or permitted by law. Our website and apps may also use cookies and similar technologies to collect information such as IP address, browser type, device information, pages visited and session activity to operate our digital services and improve performance. You can manage cookies through your browser settings, but some website functions may be affected.

6. Storage, security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including through physical, technical and administrative safeguards. We retain personal information only for as long as reasonably necessary for our functions and activities, to comply with legal obligations, resolve disputes and enforce our agreements. When personal information is no longer required, we will take reasonable steps to destroy or de-identify it, unless we are required by law to keep it.

7. Overseas disclosure

Some of our service providers, such as cloud hosting, software, payment or communications providers, may store or process personal information outside Australia. Where this occurs, we will take reasonable steps to ensure that overseas recipients handle personal information in a manner consistent with applicable privacy obligations, unless an exception under law applies.

8. Access and correction

You may request access to the personal information we hold about you, or request correction of inaccurate, out-of-date, incomplete, irrelevant or misleading information, by contacting us using the details below. We may need to verify your identity before processing a request. In some circumstances, the law permits us to refuse access or correction, in which case we will explain our decision in writing where required.

9. Privacy complaints

If you have a complaint about how we have handled your personal information, please contact us first and provide details of your complaint. We will investigate and respond within a reasonable period. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner.

10. Photography and social media

      We may take photographs or video footage at our premises or during events for promotional, training, operational or community purposes.

  Where reasonably practicable, we will notify members in advance and provide an opportunity to opt out of being featured in promotional content.

  Members and visitors must not photograph or film other people at the studio without their consent.

  Photography and filming are strictly prohibited in bathrooms, change rooms and other designated private areas.
